Morris Law, LLC recently settled a denied worker’s compensation hip injury for $91,000.00. Morris Law, LLC’s client was injured while unloading a pallet of goods inside a box store. At the time of the injury, our client worked for a contractor of said box store. When our client fell, she injured her hip, requiring an eventual replacement surgery. From the onset, our client’s claim was denied. Our client’s employer claimed that she was an independent contractor, not an employee, and therefore, not entitled to workers’ compensation benefits under South Carolina law.
Attorney Jeffrey D. Morris of Morris Law, LLC was able to show that our client was an employee through an analysis of factors based on Chavis v. Watkins, 180 S.E.2d 648, 649 (S.C. 1971). Generally, the law in South Carolina requires an independent contractor to: (1) exercise independent employment; (2) contract to do work according to his/her own methods; and (3) not be subject to the control of his/her employer except for the result of the work.
Worker’s compensation injury attorney Jeffrey D. Morris was able to secure the $91,000.00 settlement on behalf of Morris Law, LLC’s client.
