South Carolina generally gives you three years from the date of the crash to file a lawsuit against the at-fault driver, under S.C. Code Section 15-3-530. Certain exceptions can shorten or extend that window depending on the circumstances. South Carolina also follows a modified comparative negligence rule, sometimes called the 51% bar rule.
